Terms of Service

These terms cover the apps and extensions published by Earlywick on the Zoho Marketplace and the Atlassian Marketplace. Purchases, billing, and refunds are handled by those marketplaces under their own terms, not by Earlywick.

1. Who we are

Earlywick is an independent software developer based in India, publishing apps and extensions through the Zoho Marketplace and the Atlassian Marketplace. Contact: support@earlywick.com.

2. Licence

Subject to these terms and to payment of any applicable fees, Earlywick grants you a non-exclusive, non-transferable licence to install and use its apps within the Zoho or Atlassian account for which they were obtained, for as long as your subscription remains active.

You may not redistribute, resell, sublicense, or reverse-engineer the apps except where such restriction is prohibited by law.

3. Payment and billing

Fees, trials, invoices, taxes, and refunds are administered by the marketplace through which you obtained the app. Earlywick does not process payments and does not hold your payment details. Refund eligibility follows the relevant marketplace's policy.

Prices may change. Where a change affects an existing subscription, it will apply from the following billing period.

4. Your data

Earlywick's apps run inside the host platform and store data within that platform's own storage. Earlywick does not receive, host, or have access to your content. What each app reads and stores is set out in its privacy policy, linked from the homepage.

You are responsible for the content you enter into the apps and for ensuring you have the right to store it in your account.

5. Availability and support

Support is provided by email at support@earlywick.com. We aim to respond within two business days. We do not offer a guaranteed response time or uptime commitment.

The apps depend on the host platform's APIs. If a platform changes or withdraws an API, an app's behaviour may change or a feature may stop working. We will make a reasonable effort to adapt, but cannot guarantee continued operation of any feature.

6. No warranty

The apps are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the apps will be uninterrupted, error-free, or that any defect will be corrected.

7. Limitation of liability

To the maximum extent permitted by law, Earlywick's total liability arising out of or relating to the apps is limited to the amount you paid for the app in the twelve months preceding the event giving rise to the claim.

Earlywick is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost or corrupted data, even if advised of the possibility of such damages.

Nothing in these terms excludes liability that cannot lawfully be excluded.

8. Suspension and termination

You may stop using an app at any time by uninstalling it and cancelling any subscription through the marketplace. Uninstalling may permanently delete app-configuration data held in the host platform's extension storage; each app's privacy policy states what is deleted.

We may suspend or terminate access where required by law, by a marketplace operator, or in response to misuse that threatens the security of the app or other users.

9. Changes to these terms

We may update these terms. The current version is always published at this address, and the "Last updated" date above will change. Continued use after a change constitutes acceptance of the revised terms.

10. Governing law

These terms are governed by the laws of India, and the courts of India shall have jurisdiction over any dispute arising from them, save where mandatory local consumer law provides otherwise.
